How Does the Divorce Process Work?
To gain a divorce, you will need to be able to prove that your marriage has irretrievably broken down. If you have been married for less than one year, you may not need to get divorced. Instead, you may be able to have your marriage annulled.
If you have been married for more than a year, several reasons can be used to prove that your marriage has irretrievably broken down:
- Unreasonable behaviour
- Desertion - your husband or wife left at least two years before you apply to divorce them
- Separation for at least two years - where both parties agree to the divorce in writing and have been apart for more than two years
- Separation for at least five years - couples that have been separated for at least five years even if your spouse disagrees with the divorce
Getting divorced also involves deciding on other matters such as arrangements for your children, along with dividing finances and assets.
